Terms of Service

Important Notice

Before using "BackendPulse" (hereinafter "the Application" or "the Service"), please carefully read and fully understand all the contents of this Agreement. If you do not agree to any terms of this Agreement, please stop using the Application and related services immediately.

Your use of the Service indicates that you have read, understood, and agree to be bound by all terms of this Agreement.

Service Description

"BackendPulse" is a server availability monitoring application used to perform regular availability checks and heartbeat task execution on the servers/APIs you configure, and provides task records, status display, trend analysis, and statistical information.

The Service is designed to help developers, operation and maintenance personnel, and related users conveniently monitor the health status of their services.

Account & Security

Account Registration & Use

• You need to use a valid email address to register an account
• You should properly keep your account and password, and must not transfer, lend, or share your account with others
• You are fully responsible for all activities and behaviors under your account

Account Security

• If you find that your account has been used without authorization or there are other security issues, please contact us immediately through the in-app feedback function
• You are responsible for account security issues caused by your own reasons (such as password leakage)
• We recommend that you enable email verification to improve account security

User Conduct Norms

Lawful Use

• You promise to comply with the laws and regulations of the People's Republic of China and the relevant laws of your region
• You must not use the Service to engage in any illegal or infringing behavior on the legitimate rights and interests of others
• You must not use the Service for commercial fraud, spreading illegal information, or implementing cyber attacks

Monitoring Behavior Restrictions

• You may only monitor servers/APIs that you own or have been authorized to access
• Strictly prohibited from conducting unauthorized probing, scanning, attacks, or other behaviors on others' systems
• Strictly prohibited from using this Application for high-frequency malicious requests, DDoS attacks, or other destructive behaviors
• This Application does not support any unauthorized monitoring, probing, or attack behaviors. If violations are found, we have the right to immediately terminate your service and reserve the right to pursue legal liability

Content Norms

• You must not upload, publish, or disseminate illegal, obscene, violent, fraudulent, infringing, or other harmful information
• When using the feedback function, you should express yourself civilly and must not send abusive, harassing, or spam messages

Data & Content

Your Data

• The data you configure/generate in the Application (such as server configurations, task records, etc.) belongs to you
• You should ensure the legality of the monitoring targets and related data you configure, and assume full responsibility for this
• We will not actively view, analyze, or share your data content, unless necessary to provide and improve services, or to respond to lawful requirements from laws, regulations, and government agencies

Data Use

• We have the right to reasonably use your data within the scope necessary to provide and improve services
• We may restrict or block abnormal requests (such as excessively high frequency, suspected attacks, etc.) to protect the platform and others' rights and interests
• If your behavior violates this Agreement or laws and regulations, we have the right to handle or delete related data according to law

Service Changes & Interruptions

Service Adjustments

We have the right to change, upgrade, suspend, or terminate some or all functions of the Service based on business development, technical upgrades, or other reasons. For major changes, we will notify you in advance through in-app or email methods.

Service Interruptions

We are not responsible for service interruptions, data loss, or other issues caused by the following circumstances:

• Force majeure (such as natural disasters, wars, strikes, etc.)
• Technical reasons such as network failures, power outages, hardware failures, etc.
• External factors such as government actions, changes in laws and regulations, etc.
• Third-party destructive behaviors such as hacker attacks, virus intrusions, etc.
• Users' own device or network issues

We will make reasonable efforts to assist in service recovery and reduce losses, but we are not responsible for indirect losses caused by service interruptions.

Intellectual Property

• All intellectual property rights (including but not limited to software code, interface design, trademarks, copywriting, etc.) of this Application and related services belong to us or related rights holders
• When using the Service, you must not reverse engineer, crack, modify, copy, or use the Application for commercial purposes
• Without authorization, you must not use the name, trademark, or other identifiers of this Application

Disclaimer

• The Service is provided "as is", and we make no express or implied warranties regarding the accuracy, completeness, timeliness, stability, or applicability of the Service
• You assume the risks of using the Service yourself, and we are not responsible for any direct or indirect losses (including but not limited to data loss, business interruption, profit loss, etc.) arising from the use of the Service
• We are not responsible for the availability or stability of third-party services (such as the target servers you monitor, network service providers, etc.)
• You are solely responsible for any consequences (including legal liability, economic losses, etc.) arising from violations of this Agreement or laws and regulations

Agreement Changes

We have the right to modify this Agreement based on business development, changes in laws and regulations, or other reasons. The modified Agreement will be published in the Application or notified to you via email. If you do not agree to the modified Agreement, you may choose to stop using the Service; if you continue to use it, you are deemed to accept the modified Agreement.

Applicable Law & Dispute Resolution

• The conclusion, performance, interpretation, and dispute resolution of this Agreement shall be governed by the laws of the People's Republic of China
• If any provision of this Agreement is deemed invalid or unenforceable, that provision shall be deemed severable and shall not affect the validity of other provisions
• Any dispute arising from or relating to this Agreement shall first be resolved through friendly negotiation; if negotiation fails, either party may bring a lawsuit to the people's court with jurisdiction where we are located
